Throughout the site, the terms “we”, “us” and “our” refer to YLATI FOOTWEAR. YLATI FOOTWEAR offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
Eligibility to Purchase
The purchase of merchandise through Ylati footwear is strictly limited to parties who can lawfully enter into and form contracts on the Internet in accordance with the laws of the NETHERLANDS. In order to make purchases on the Site you will be required to provide your personal details and payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided.
By making an offer to purchase merchandise you expressly authorize us to perform credit checks and where Ylati footwear feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.
Ylati footwear reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address.
We accept Paypal, Visa, Mastercard, and American Express credit cards.
Although availability may be indicated on the Website, we cannot guarantee product availability and products, nonetheless, may not be available for immediate delivery.
We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order.
We have made every effort to display as accurately as possible the colors of our products that are displayed on the Website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. Therefore the pictures of our products on the Website are for illustrative purposes only.
You can only place an order if 1) you are a consumer, 2) who is at least 16 years of age, or has the consent of at least one of parents and/or guardians place an order and 3) who provides us correct information that is necessary for the fulfillment of the order.
An order placed by you is an offer to purchase the product(s) displayed on our Website, which offers needs to be accepted by Ylati footwear.
Once the order is placed by you, we will send you an order acknowledgment email, to let you know that we have received your order. This order acknowledgment email does not constitute an acceptance of your order or the conclusion of a contract. Ylati footwear reserves all rights to reject your order for any reason and with no liability to you or any third parties prior to Ylati footwear acceptance of your order.
Our acceptance of your order and conclusion of the contract will only take place when we send you an email confirming that your order has been dispatched.
Purchased products will be shipped within 3 working days starting on the date of the order.
Delivery will be arranged as follow:
Italy: within 1 workday
European Union: between 1-2 workdays
Outside Europe: between 3-5 workdays. Shipping fees will be calculated at checkout. Taxes, Duties or Brokerage fees will not be calculated at checkout.
By completing this order the customer is in agreement that they are responsible for all taxes, duties, brokerage fees, Customs fees or similar charges (including V.A.T).
Also, the customer is in agreement that they are responsible for all original outgoing shipping costs and all shipping costs on items that are sent back.
Customs and Taxes
Ylati Footwear is not responsible for any customs, duties, taxes, or brokerage fees applied to your package. You will be responsible for paying these additional charges for customs clearance. We must declare all items at their full price and cannot change this amount to lower custom fees.
If you refuse your package, you are responsible for the original shipping charges as well as any custom fees or taxes that are incurred. If the package is undeliverable and returned to ylatifootwear.com, the shipping and return shipping total charges will be deducted from your merchandise payment amount refunded. In the instance that the price to return the merchandise exceeds the total amount of the merchandise including shipping costs, the package will be abandoned and you will not be refunded.
Tracking information will not be available until your package ships and has left our warehouse. Please note: Depending on carrier, tracking information may not be available until 24 hours after courier has received the package. Once your order ships, you will receive confirmation e-mail with your tracking number. Also, the customer is in agreement that they are responsible for all original outgoing shipping costs and all shipping costs on items that are sent back.
Returns / Exchanges
Our returns guarantee entitles you to return the product for any reason within 14 days of having received it. You have the right to open the package and check the product but the product must be returned unused.
All original packaging, price labels etc. shall be returned.
PLEASE NOTE THE PRODUCT MUST BE UNWORN, UNUSED AND IN THE SAME CONDITION AS RECEIVED
Ylati Footwear can only accept returns/exchange from purchases made on ylatifootwear.com. If a product was purchased at another retailer, it must be returned/exchanged where it was purchased
If you return an order, always keep your tracking number and receipts so you have proof of shipment.
When returning goods please ensure that you notify us first by email with the reason of the return, the purchase order number and we will send you the #RMA number.

When returning and/or exchanging an item the customer is responsible for delivery cost, customs charges, duties and/or VAT that may apply.
Shipping costs will not be refunded unless there was a mistake in delivery caused by us.
Please note that orders placed during our sale cannot be returned, exchanged and/or refunded.

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
The prices displayed on the Website are quoted in Euros, including VAT and excluding delivery costs and custom duties fees, if applicable.
Ylati footwear only offers the payment methods displayed during the checkout process.
All payments are subject to authorization and validation checks done by the payment service provider. In the event that the payment service provider does not, for any reason, authorize or validate your payment, Ylati footwear shall cancel your order and notify you thereof.
We may provide promotional codes offering a discount on our merchandise. Promotional codes cannot be used on past purchases. Promotional codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotional code or offers, and must be used by the date published, if any. Only one promo codes can be used at checkout. We reserve the right at any time without notice to retract and/or change the terms of promotional codes.
In the event that our courier is unable to deliver a package due to an incorrect address entered by the customer, the customer’s refusal to pay duties, multiple failed attempts to reach the customer at point of delivery, or otherwise, Ylati Footwear is not responsible for payment of return shipping costs levied by the courier. Similarly, Ylati Footwear is not responsible for the payment of re-shipping merchandise to the customer. In cases such as these, the customer is responsible for all shipping costs associated with returned packages due to failed delivery.
Ylati Footwear is not responsible for unexpected shipping delays caused by circumstances such as severe weather or natural disasters. We are not responsible for unexpected shipping delays caused by circumstances related to the courier itself, such as clearance delays.
You agree to indemnify, defend and hold harmless Ylati footwear and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
2. Complaints about the implementation of the agreement must be submitted to Ylati footwear expeditiously after the consumer has observed the defects in a complete and clearly described manner.3. Complaints submitted to Ylati footwear are answered within a period of 7 days after the date of receipt. If a complaint foreseeably requires a longer processing time then Ylati footwear answers within the period of 14 days with a confirmation of receipt and an indication when the consumer can expect a more extensive answer.4. A complaint about a product, service or the service of Ylati footwear can also be submitted by email via firstname.lastname@example.org. The consumer must, in any case, give Ylati footwear a period of 4 weeks to solve the complaint in joint consultation. After this period a dispute arises that is susceptible to the dispute settlement rules.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Natherlands.
